Kyle W. Wilcox is a member at Simmons Perrine Moyer Bergman where he is engaged primarily in the estate planning, probate, tax and general corporate and business law practice areas.

Estate Planning. Mr. Wilcox works with individuals and families to plan the disposition of their assets, both during lifetime and at death, and to accomplish the optimal estate and gift tax planning for the clients through wills, trusts and other instruments. Mr. Wilcox frequently drafts estate plans that include disclaimer and credit shelter trusts, qualified personal residence trusts (“QPRTs”), grantor retained annuity trusts (“GRATs”), irrevocable life insurance trusts (“ILITs”), intentionally defective grantor trusts (“IDGTs”), special and supplemental needs trusts, minors' trusts and premarital agreements. Mr. Wilcox is regularly involved in the analysis of issues related to lifetime gifting programs and estate and generation-skipping tax planning. In addition, Mr. Wilcox regularly prepares health care directives, healthcare powers of attorney, financial powers of attorney and beneficiary designations for life insurance and retirement plans.

Probate. To help families after the loss of a member of the family, Mr. Wilcox helps clients with the administration of trusts and estates and works to resolve trust and estate controversies.

Guardianships and Conservatorships. Mr. Wilcox assists clients in appointing conservators or guardians for minors and incompetent adults. Mr. Wilcox also counsels clients in the ongoing management of the conservatorship or guardianship, the required court reports and proceedings and other administration requirements of the conservatorship or guardianship.

Taxation. Mr. Wilcox counsels clients on the tax consequences associated with proposed business transactions and estate planning techniques. In addition, Mr. Wilcox prepares personal income and gift tax returns. Mr. Wilcox regularly prepares fiduciary income tax returns for our estate and trust clients.

General Corporate and Business Transactions. Mr. Wilcox advises businesses on issues relating to initial business structures and continuing business opportunities, including the review, negotiation and drafting of a variety of business contracts, organizational documents, shareholder agreements, buy-sell agreements and asset purchase agreements and stock purchase agreements. In addition, Mr. Wilcox has represented clients in both the sale and acquisition of stock and corporate assets.

General practice including, but not limited, to estate planning, wills, trusts, probate, taxation, income tax preparation, conservatorships and guardianships, and corporate and business law.

Prior to joining Simmons Perrine Moyer Bergman in 2006, Mr. Wilcox was an associate in the corporate and business law practice group of Hellmuth & Johnson, PLLC, in Minneapolis, Minnesota.
